Acceptable Use

This page defines the Acceptable Use Policy of Adept Business Systems Pty Ltd, the developer and owner of Surga Central. Your use of Surga Central is subject to this policy. If you breach this policy, we reserve the right to suspend or terminate your account with immediate effect.

Definitions

For the purposes of this Acceptable Use Policy, all references to “Adept”, “we”, “us” or “our” in this statement are references to Adept Business Systems Pty Ltd (ABN 85 003 467 794) and/or Adept Business Systems UK Limited (Company No: 09464292).

The terms “customer”, “you” or “your” in this document includes all visitors to our website, subscribers, purchasers and users of our services and products.

The terms “Surga Central” or “Surga” refers either to the business or the online platform as the context requires.

The term “website” refers to websites with the URL www.surgacentral.com or www.surgacentral.com.au.

The term “electronic messages” refers to email, instant messaging, SMS and MMS (text and image-based mobile phone messaging).

 

Anti-Spam Policy

You may not use or allow a third-party to use the platform to send unsolicited commercial messages whether by email, SMS or direct mail.  This includes sending messages in violation of relevant Anti-Spam or privacy regulations such as those embodied in GDPR or the Privacy and Electronic Communications (EC Directive) Regulations 2003.  You should not store the personal information of individuals for whom you do not have consent or for whom there is no basis (such as contractual or legitimate interest) for storing personal information without consent.

The key steps that you should follow include:

  1. Consent - Only send commercial electronic messages with the addressee’s consent - either express or inferred consent. Record the basis of why you believe you have inferred consent.
  2. Identify - Include clear and accurate information about the person or business that is responsible for sending the commercial electronic message.
  3. Unsubscribe - Ensure that a functional unsubscribe facility is included in all your commercial electronic messages. Deal with unsubscribe and erasure requests promptly.

In addition, you are responsible for ensuring that the electronic messages you send in connection with your business operations do not generate a volume of spam complaints in excess of industry standards. If we determine that the volume of spam complaints is higher than industry standards, we reserve the right to consider that you have breached this policy and suspend or terminate your account.

We prohibit the use of third-party, purchased or rented mailing lists, unless you are able to provide proof that individuals on the list have opted-in to receiving electronic messages of the type you will be sending.

You should ensure that your customer details are reasonably accurate and up-to-date.

You should make every effort to segment your electronic messages into groups of similar attributes so you can transmit relevant data to your target audience.

 

Prohibited Content Policy

The platform must not be used to send anything offensive, to promote anything illegal, or to harass anyone. This includes:

  • Pornography or other sexually explicit material
  • Electronic messages promoting or selling illicit substances
  • Electronic messages that violate privacy or other relevant legislation
  • Hate-related or violent material or material advocating discrimination against people
  • Malicious code

 

Change Notifications

Any changes to our Acceptable Use Policy will be posted to this website. Changes to the Acceptable Use Policy will become effective as of the date we post on the website and will generally be notified by means of news updates on our website.

 

Reporting Spam

If you suspect that Surga Central has been used by someone in breach of this policy, please contact us immediately at abuse@adept.com.au
